General Terms and Conditions of Sale
1. Introduction
This contractual document shall govern the General Terms and Conditions (hereinafter, “Conditions”) for products purchased through the website eclipseglassesspain.com (hereinafter, “the Website”), owned by Peitho Marketing LLC under the commercial brand “Spectrum Eclipse Glasses™“, whose details appear in the Legal Notice of this Website (hereinafter, “SPECTRUM“).
These Conditions are published on the Website for the CUSTOMER to reproduce and save as confirmation of the contract and may be modified at any time by SPECTRUM. It is the CUSTOMER’s responsibility to read them periodically, as those in force at the time of placing orders are applicable. SPECTRUM will archive the electronic document of the purchase, and the CUSTOMER should also keep a copy.
Acceptance of this document implies that the CUSTOMER:
- Has read, understands, and comprehends what is stated herein.
- Is a person with sufficient legal capacity to enter into a contract.
- Assumes all obligations set forth herein.
These Conditions are available in several languages. In the event of a discrepancy or conflict in interpretation, the Spanish version shall prevail over all other versions, as it is the original language of the document and the official language of the primary target market.
2. Identity of the Contracting Parties
On one hand Peitho Marketing LLC (hereinafter, SPECTRUM), with registered office at 539 W. Commerce St #4973, Dallas, TX 75208, USA, and NIF (Spanish Tax ID) N0396110I. On the other hand the CUSTOMER, who performs the purchase and is exclusively responsible for the veracity and custody of the data provided.
3. Object of the Contract
This contract regulates the purchase and sale relationship between SPECTRUM and the CUSTOMER, which is perfected when the CUSTOMER accepts these Conditions by checking the corresponding box during the online checkout process. This relationship involves the delivery of solar observation eye protection products (eclipse glasses) that comply with applicable safety regulations in exchange for a price displayed on the Website.
4. Product Offer Conditions
4.1. Product Information
SPECTRUM provides detailed information on technical specifications, materials, and safety certifications of the product sold. As the product is eye protection equipment, special emphasis is placed on compliance with the international ISO 12312-2:2015 standard for direct solar observation. The CUSTOMER acknowledges that slight variations in color or brightness may exist due to photography quality or monitor calibration; such minor differences shall not be considered a lack of conformity.
Before confirming the purchase, the CUSTOMER will be able to review the complete breakdown of the order: technical characteristics, units, unit price, availability, shipping costs, possible discounts, applicable taxes, and the total amount of the transaction.
4.2. Prices and Validity
Prices are expressed in EUROS and include Value Added Tax (VAT) of the destination country via the EU One-Stop Shop (OSS).
For shipments to non-EU countries, the Canary Islands, Ceuta, or Melilla, the CUSTOMER shall bear all customs duties, tariffs, or local taxes.
SPECTRUM reserves the right to modify the prices appearing on the Website at any time and without prior notice. Such changes shall not affect orders for which a confirmation has already been sent to the CUSTOMER.
Offers are valid while visible on the Website and subject to stock availability. In case of stock breakage after an order is placed, SPECTRUM will issue a full refund immediately.
4.3. Promotions, Raffles, and Special Events
General Framework: SPECTRUM may carry out various promotional actions, including temporary discounts, raffles, creative competitions, and referral programs. An overview of our promotional actions is provided on the Promotions Page. Each specific action will be governed by its own “Specific Terms and Conditions” available on the dedicated page for that promotion. In the event of a conflict between these General Conditions and the Specific Terms and Conditions of a promotion, the latter shall prevail for that specific action.
Automatic Entry and Scope: The CUSTOMER is informed that the automatic entry into certain raffles or sweepstakes is a benefit exclusive to purchases made directly through the official SPECTRUM websites eclipseglassesspain.com and gafasparaeclipsesolarespaña.com. Entry is formalized at the moment the purchase is completed on the aforementioned domains.
Promotional Pricing and Discounts: Promotions and discounts are valid only during the periods and under the specific conditions indicated on the Website.
Prizes and Giveaways: Prizes obtained through raffles or competitions are personal and non-transferable, and in no case may they be exchanged for their cash value. For physical prizes requiring delivery, the logistics will be coordinated according to the Specific Terms and Conditions, and may be restricted to certain geographical areas.
Modification and Cancellation: SPECTRUM reserves the right to modify, suspend, or cancel any promotional action for technical, legal, or logistical reasons, provided that such changes do not harm rights already acquired by CUSTOMERS who have already fulfilled the participation requirements.
4.4. Payment Methods
SPECTRUM offers the following secure payment methods:

- Google Pay
The Website uses SSL and HTTPS protocols to ensure a secure environment and complies with PSD2 regulations and Strong Customer Authentication (SCA). SPECTRUM does not store full credit card details.
SPECTRUM may use duly authorized payment service providers and collection agents operating under current banking security standards. The charge to the CUSTOMER’s account will be made at the time of order confirmation.
4.5. Security Measures
The Website uses information security techniques generally accepted in the industry, such as SSL, data entered on secure pages, firewalls, access control procedures, and cryptographic mechanisms, all with the aim of preventing unauthorized access to data. To achieve these purposes, the CUSTOMER accepts that SPECTRUM may obtain data for the effect of the corresponding authentication of access controls.
SPECTRUM undertakes not to permit any transaction that is considered illegal by the credit card brands or the acquiring bank and that has or may have the potential to damage their goodwill or negatively influence them. Pursuant to the card brands’ programs, the sale or offer of a product or service that does not comply with all laws applicable to the Buyer, Issuing Bank, Merchant, or Cardholder is prohibited.
The Website uses industry-accepted information security techniques (SSL, HTTPS) to ensure a secure shopping environment. The payment process complies with European PSD2 regulations, applying Strong Customer Authentication (SCA) protocols to validate transactions and protect the CUSTOMER against fraud.
SPECTRUM does not store complete credit card data; these are managed directly by the financial institution through its secure gateway.
5. Contracting Procedure
5.1. General Contracting Clauses
In order to purchase SPECTRUM products, the CUSTOMER must be of legal age (18 years) and have the necessary legal capacity to enter into a contract. If acting on behalf of a legal entity, the CUSTOMER declares that they have the necessary powers of representation to make the purchase.
The CUSTOMER shall freely and voluntarily provide the personal (and, where applicable, corporate) data required for the order. These will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), as detailed in our Privacy Policy. The CUSTOMER is solely responsible for the veracity of the data provided.
Placing an order implies full acceptance of these Conditions. Any stipulation provided by the CUSTOMER that differs from what is set forth herein shall have no legal validity unless expressly accepted in writing by SPECTRUM. These Conditions shall prevail over any agreement to the contrary, except for specific agreements signed between both parties.
In accordance with Art. 27 of Law 34/2002 (LSSICE), notice is hereby given that the contracting procedure will follow the steps described below:
5.2. Purchase Process
SPECTRUM specializes in the marketing of Individual Protection Equipment (PPE) for direct solar observation, certified under the ISO 12312-2 standard. Due to the specialized nature of our catalog, the purchase process is carried out directly and simplified on the product page (https://eclipseglassesspain.com/product/buy-spectrum-solar-eclipse-glasses/), following these steps:
- Shipping and Billing Data: The CUSTOMER will enter their contact details and delivery address. If the billing address is different from the delivery address, the CUSTOMER may check the corresponding box and enter the specific billing data.
- Quantity Selection: The CUSTOMER will indicate the number of units desired. The total amount (including VAT and shipping costs) will be updated dynamically before payment.
- Verification: The CUSTOMER verifies the amounts of their order.
- Acceptance of Conditions: Before proceeding to payment, the CUSTOMER must check the acceptance box for these General Contracting Conditions. This act formalizes the purchase and sale contract.
- Payment Method Selection: The CUSTOMER will choose from the available options (Card, Bizum, Apple/Google Pay, or Transfer).
- Management of Transfers: In the case of opting for a bank transfer, the CUSTOMER must send proof of the operation by email, indicating their name and order number. The order will not be processed or shipped until the effective receipt of funds. SPECTRUM reserves the right to cancel any order pending transfer after 5 calendar days.
- Confirmation and Invoice: Once the payment is verified, SPECTRUM will send a confirmation email attaching the corresponding invoice. The CUSTOMER expressly accepts the issuance of the invoice in electronic format, which will be sent to the provided email address.
5.3. Order processing and Delivery of Orders
Processing: The shipment will be processed once stock availability is confirmed and full payment is verified (in the case of transfers, the period will begin to count after the effective receipt of funds). The internal preparation time in our logistics center is 1 to 3 business days.
Delivery Times: Transport will be carried out by MRW. The delivery time will depend on the destination and the selected modality (Standard/Premium), generally ranging between 1 and 10 business days in addition to the preparation time. These times are indicative.
Place and Status of Delivery: Delivery is considered made at the moment the carrier makes the product available to the CUSTOMER or an authorized third party at the indicated address. In case of absence by the CUSTOMER, the courier company will leave the corresponding notice with instructions for re-delivery or collection at the stipulated collection point (MRW office or associated point).
CUSTOMER
Responsibility: The CUSTOMER must follow the collection instructions of the carrier within the established period. SPECTRUM will not assume responsibility or the costs of a new shipment if the delivery is not completed due to false, inaccurate, or incomplete data provided, or if the package is returned to our facilities for not having been withdrawn from the collection point in time and form. In these cases, the CUSTOMER must pay the new shipping costs if they desire a second attempt.
Transport Incidents: SPECTRUM will respond to the CUSTOMER for any lack of conformity in the delivery. However, if the delay or incident is exclusively attributable to the courier company, SPECTRUM will carry out the necessary steps to resolve the incident as soon as possible.
Unavailability: In case of stock breakage or impossibility of delivery on the estimated date, SPECTRUM will inform the CUSTOMER, offering the possibility of waiting for the new period or receiving a full refund of the amount paid, which will be processed immediately.
5.4. Transport Costs
SPECTRUM ships both to national territory (Spain) and the rest of the world. Shipping costs are calculated based on the selected transport modality (Standard or Premium), the total weight of the order, and the delivery address.
The CUSTOMER can consult the exact cost of shipping dynamically on the purchase page before formalizing the purchase. Likewise, an indicative table of costs according to geographical area and weight is made available on said page.
The maximum weight allowed for international shipments is 60 kg per expedition. If an order exceeds said weight, it must be split into two or more shipments, and the CUSTOMER must assume the corresponding cost difference.
Taxes outside the EU: The CUSTOMER is reminded that transport costs do not include tariffs, import taxes, or local taxes that may be applicable in the destination country outside the European Union (or territories with special tax regimes such as the Canary Islands, Ceuta, or Melilla). These amounts shall be borne exclusively by the CUSTOMER.
5.5. Returns Policy, Defective Products, and Errors
Guarantee of Conformity: SPECTRUM guarantees that all delivered products comply with the specifications of the contract. The CUSTOMER must verify the status of the order upon receiving it.
Transport Incidents and Hidden Damages: In case of evident external damage to the package, the CUSTOMER must obligatorily record it on the carrier’s delivery note (or digital signature device). For damage not visible externally (hidden damage), the CUSTOMER must communicate the incident to SPECTRUM within a maximum period of 24 hours after receipt.
Complaint Procedure: To process these incidents, the CUSTOMER must provide the requested graphic evidence (photos of the product, packaging, and shipping label) within a maximum of 24 hours after receipt to facilitate the claim against the carrier. The lack of notification or provision of these proofs within the indicated period will make it impossible to validate the claim before the transport entity, it being understood that the product was delivered in conformity and that any subsequent damage is the responsibility of the CUSTOMER.
Solutions: If the CUSTOMER receives a product damaged during transport or with any lack of conformity, SPECTRUM undertakes to offer the most suitable solution. Depending on the circumstances, the CUSTOMER may opt for:
- Product replacement: We will send a new replacement item as soon as possible (subject to availability and critical event dates).
- Full refund: Termination of the contract and full credit of the amount paid.
- Partial refund: In orders of several units, the credit will be prorated for the affected units if the rest are functional.
Right of Withdrawal and Exceptions (PPE): In accordance with Art. 102 of RDL 1/2007, the CUSTOMER has 14 calendar days to withdraw from the purchase. However, the CUSTOMER is informed of the following special conditions:
- Health and Hygiene Exception (Art. 103.e): Eclipse glasses are Individual Protection Equipment (PPE) with certified solar filters. For reasons of health protection and eye safety, this right shall not be applicable to products that have been unsealed or whose original packaging has been manipulated after delivery.
- Product Depreciation (Art. 108.2): Any breaking of the seal or manipulation of the packaging prevents guaranteeing the technical integrity of the solar filter for future sales, resulting in a depreciation of 100% of the value of the product, as it is not suitable for being put back on the market for safety reasons.
Scope of Application of Withdrawal (B2B vs B2C): In accordance with current regulations, the Right of Withdrawal is an exclusive faculty of Consumers and Users. Therefore, this right shall not be applicable to purchases made by natural or legal persons acting within the framework of a business or professional activity (B2B), such as companies, public entities, or freelancers who provide their NIF/CIF for purchase invoicing. In these transactions, the contract is governed by the Commercial Code and the conditions stipulated herein, without the possibility of return by withdrawal.
5.6. Claims and Online Dispute Resolution
Any claim that the CUSTOMER deems appropriate will be attended to as soon as possible and can be made through the email ‘claims [at] eclipseglassesspain [dot] com’.
We commit to addressing all requests as quickly as possible.
Online Dispute Resolution: In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform, which is available at the following link: https://ec.europa.eu/consumers/odr.
5.7. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations if such failure is due to causes of Force Majeure or Fortuitous Events.
Causes of force majeure are considered to include, but are not limited to: natural disasters, transport strikes external to SPECTRUM, generalized failures in telecommunications networks, acts of terrorism, pandemics, or government restrictions. In such cases, the fulfillment of obligations will be delayed until the cessation of said cause.
However, if the cause of force majeure persists such that the product cannot be delivered before the date of the astronomical event for which it was purchased, the CUSTOMER shall be entitled to a full refund of the amounts paid, without further claim for damages and interests.
5.8. Order Deadline (Cut-off Date)
Given that SPECTRUM products are linked to an astronomical event with a fixed and immovable date, SPECTRUM will establish a contracting deadline to ensure that shipments can be delivered on time by the courier company.
Cessation of Shipments: Once said date (duly communicated on the Website) has passed, SPECTRUM reserves the right to deactivate the sale or cancel orders received if, under logistical criteria, there is no reasonable guarantee of delivery before the event.
Responsibility: SPECTRUM is not responsible for purchases made in excessive proximity to the event that, due to causes beyond our logistics (carrier delays or absence of the recipient), do not arrive in time for the observation of the phenomenon. In these cases, as it involves a PPE whose integrity cannot be guaranteed after a return, the provisions of Section 5.5 regarding withdrawal shall apply.
5.9. After-Sales Guarantees and Services
Legal Framework: In accordance with RDL 1/2007 (General Law for the Defense of Consumers), SPECTRUM guarantees that the products are in conformity with the contract. Since these are fungible goods and protective equipment, the guarantee covers manufacturing defects existing at the time of delivery.
Manufacturer and Importer Responsibility: SPECTRUM guarantees that the product has the ISO 12312-2 certifications and the corresponding CE marking. The guarantee is limited to the replacement or refund of defective products that do not meet said technical safety specifications at the time of receipt.
Exclusions: The guarantee shall not apply in the event of:
- Negligent handling or use contrary to the safety instructions attached to the product.
- Natural wear and tear or damage caused by inadequate storage by the CUSTOMER.
- Use of the glasses after the expiration date or indicated event, if the solar filter could have degraded due to exposure to external elements.

7. Assignment, Nullity, and Acceptance
Non-transferability: The CUSTOMER may not assign, transfer, or transmit the rights, responsibilities, and obligations derived from this contract to third parties without the prior written consent of SPECTRUM.
Partial Nullity: If any of these stipulations were declared null, illegal, or unenforceable by a competent authority or court, such nullity shall not affect the validity and fulfillment of the rest of the conditions, which shall remain in force in their full extension.
Acceptance: The CUSTOMER declares to have read, understood, and accepted these conditions in their entirety by checking the acceptance box during the purchase process.
8. Suspension or Termination of the Contract
Faculty of Suspension: SPECTRUM may, without prior notice, suspend or terminate the CUSTOMER’s access to its services and cancel any order in progress, in whole or in part, when it is detected that the CUSTOMER breaches the obligations established in this contract or any legal provision, regulation, or policy applicable.
Non-payment or Fraud: Specifically, SPECTRUM reserves the right to terminate the contract in cases of non-payment (transfers not received within the deadline) or upon well-founded suspicions of fraudulent transactions, thus protecting the integrity of the inventory for the rest of the users.
Reservation of Rights: When SPECTRUM exercises any of its powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power, or legal remedy that may be available to the company to claim for damages if necessary.
9. Applicable Law and Jurisdiction
These conditions are governed by Spanish legislation. For the resolution of any controversy, the parties submit to the jurisdiction of the Courts and Tribunals of the CUSTOMER’s domicile when they hold the status of consumer. In cases of transactions with legal entities or professionals (B2B), both parties submit, with express waiver of any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Madrid (Spain).
