Total Eclipse Raffle – Terms and Conditions

1. Eligibility Requirements

1.1. Participation in the Total Eclipse Raffle (“the Raffle”) is open exclusively to individuals who meet all of the following criteria at the time of entry:

  • Are at least 18 years of age;
  • Are a natural person (legal entities are excluded);
  • Are a legal resident of a member state of the European Union;
  • Have made a qualifying purchase of Spectrum Eclipse Glasses through one of the following sales channels

1.2. The following individuals are not eligible to participate:

  • Employees, contractors, or representatives of the organizer or affiliated companies;
  • Immediate family members of such employees or representatives;
  • Any individual otherwise professionally connected to the organization or administration of the Raffle.

2. General Terms

2.1. The Raffle is conducted under official authorization number [INSERT AUTHORIZATION Nº], issued in accordance with applicable laws and regulations.

2.2. The drawing of the winning entry will take place on August 15, 2026, and will be supervised by a licensed Public Notary to ensure fairness and transparency.

2.3. Entry into the Raffle is automatic upon making a qualifying purchase, and no additional action or payment is required to participate.

2.4. By participating in the Raffle, entrants agree to be bound by these Terms and Conditions and all decisions made by the organizer, which shall be final and binding in all respects.

3. Description of the Prize

3.1. There is one (1) prize to be awarded to the first eligible entrant randomly selected (the “Winner”).

3.2. The prize consists of:

  • One (1) new electric vehicle (EV), specifically:
      • Brand: BYD
      • Model: Dolphin
      • Year: 2026
      • Color: Blue

3.3. The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other alternative.

3.4. The organizer reserves the right to substitute the prize with another item of similar or greater value in the event that the specified prize is unavailable due to circumstances beyond its control.

4. Publicity and Use of Image

4.1. By accepting the prize, the Winner agrees to participate in reasonable publicity activities related to the Raffle, including, but not limited to, the taking of photographs and video footage at the time of prize handover.

4.2. The Winner hereby grants the organizer an irrevocable, royalty-free, worldwide license to use their name, image, likeness, voice, and any statements made by them in connection with the promotion of the Raffle or other future marketing initiatives.

4.3. Such content may be used in press releases, blog articles, digital or print advertisements, email marketing, social media, and other promotional or commercial materials, without additional compensation or prior approval.

4.4. The Winner waives any right to inspect or approve the final materials in which their likeness appears and acknowledges that no further compensation shall be due.

4.5. If the Winner is unable or unwilling to participate in publicity activities, the organizer reserves the right to revoke the award and select an alternate winner.

5. Limitation of Liability

5.1. To the extent permitted by applicable law, the organizer shall not be liable for:

  • Any loss, damage, or injury incurred by participants or third parties in connection with the Raffle or the use of the prize;
  • Any technical failures, unauthorized intervention, or other causes beyond the reasonable control of the organizer that affect the operation, security, or fairness of the Raffle.

6. Data Protection

6.1. Personal data collected during the Raffle will be processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR).

6.2. Participants’ personal data will be used solely for the administration of the Raffle and, where consent is given, for marketing purposes. Data will not be shared with third parties except where required by law or necessary for fulfilling the prize delivery.

7. Governing Law and Jurisdiction

7.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.

7.2. Any disputes arising in connection with the Raffle shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights.
